These Terms of Use (“Terms”) govern your access to and use of NerveCenter (the “App”), operated by Digital Experience Co, LLC (“we,” “our,” “us”). These Terms are between you and Digital Experience Co, LLC only, not Apple. By using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility You must be at least 13 years old to use the App.
2. License Grant & Restrictions
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App
for personal, non-commercial purposes in accordance with these Terms.
You may use the App only on Apple-branded devices you own or control and as permitted by the App Store
Usage Rules. This license also permits access via Family Sharing or volume purchasing where applicable.
You may not transfer, sublicense, resell, reverse-engineer, decompile, modify, or create derivative works
of the App except where prohibited by law.
All rights not expressly granted are reserved by Digital Experience Co, LLC.
3. Medical Disclaimer
The App, including the Symptom Analysis Agent, does not provide medical advice, diagnosis, or treatment.
Insights are based solely on information you enter and may be incomplete or inaccurate.
The App does not monitor real-time conditions and must not be used in emergencies. Call emergency
services if you believe you are experiencing a medical emergency.
You agree you use the App’s outputs entirely at your own discretion and risk.
4. AI Disclaimer AI-generated responses may be inaccurate, incomplete, or contextually incorrect. They may omit relevant health factors or misinterpret entries. AI outputs are informational only, and you are solely responsible for verifying and interpreting any information.
5. User Responsibilities
You agree to:
– Provide accurate, lawful information.
– Understand that inaccurate logs may produce misleading insights.
– Not upload harmful, defamatory, or infringing content.
– Not misuse or attempt to bypass App security.
– Comply with all applicable third-party terms and agreements when using the App.
We may suspend or terminate access for violations.
6. Subscriptions & Payments
Paid features may require an auto-renewing subscription processed through the App Store,
Google Play Store, or Stripe.
– Subscriptions renew automatically unless canceled 24 hours before renewal.
– Cancellation must be done through your device settings or account portal.
– Refunds are handled solely by the payment provider.
Pricing and features may change with notice.
7. Account & Data Deletion You may delete your account and all stored data at any time. Deletion is permanent and irreversible.
8. Intellectual Property All content, code, and design elements are owned by Digital Experience Co, LLC or licensors. You may not reproduce, modify, or redistribute them without permission.
9. Warranty Disclaimer
The App is provided “as is” and “as available,” with all faults. We disclaim all warranties—express,
implied, or statutory—including merchantability, fitness for a particular purpose, accuracy, and
non-infringement.
Some jurisdictions do not allow the exclusion of warranties; these limitations may not apply to you.
10. Limitation of Liability
To the fullest extent permitted by law:
– We are not liable for indirect, incidental, consequential, or special damages, including lost profits,
data loss, emotional distress, or business interruption.
– Our total liability shall not exceed the greater of (a) the amount you paid for App services in the
12 months before the claim, or (b) $50 USD.
These limitations apply even if any remedy fails its essential purpose.
11. Indemnification You agree to indemnify and hold harmless Digital Experience Co, LLC and its employees, partners, and agents from claims arising from your use or misuse of the App or your violation of these Terms.
12. Service Availability & Changes We may modify, suspend, or discontinue the App or any feature at any time. You acknowledge that access to stored data or features may not be available after discontinuation and refunds are handled exclusively by the relevant payment provider.
13. Governing Law These Terms are governed by the laws of the Commonwealth of Virginia, USA.
14. Updates to Terms We may update these Terms from time to time. Continued use constitutes acceptance.

16. Additional Terms for iOS Users
If you download or access the App through the Apple App Store, you acknowledge that:
(a) These Terms are between you and Digital Experience Co, LLC, not Apple.
(b) Your use of the App is also subject to Apple’s Standard EULA.
(c) Apple has no obligation to provide maintenance or support.
(d) Apple and its subsidiaries are third-party beneficiaries and may enforce these Terms.
(e) Any warranties not disclaimed are provided solely by Digital Experience Co, LLC.
(f) If the App fails to conform to a warranty, you may notify Apple, who may refund the purchase price.
(g) Apple is not responsible for any claims relating to the App, including product liability or regulatory compliance.
(h) Apple is not responsible for any third-party IP infringement claims.
(i) In any conflict, the terms most protective of Apple control.
17. Legal Compliance You represent and warrant that you are not located in a country subject to a U.S. Government embargo, are not designated as a “terrorist supporting” country, and are not listed on any U.S. prohibited or restricted-party list. You agree to comply with applicable U.S. export and re-export laws.
